Agreement and eligibility

These Terms of Use ("Terms") are a binding agreement between you and Artful Intelligence, LLC governing Protocol and related services. By selecting Agree & Continue, creating an account, or using Protocol, you confirm that you have read and agree to these Terms, the Privacy Policy, and the Health & Safety Disclaimer, each incorporated by reference.

You may use Protocol only if you are at least 18 years old, have legal capacity to enter this agreement, and are not prohibited from using it by applicable law. If you use Protocol for an organization, you represent that you have authority to bind that organization, and "you" includes it. If you do not agree, do not use Protocol.

Protocol's limited purpose

Protocol is a personal organizational and arithmetic tool for user-entered records. It is not a medical service and does not replace prescription labeling, professional instructions, independent verification, or emergency care. The Health & Safety Disclaimer controls all health-related use.

You are solely responsible for your inputs, configurations, interpretation, compliance with law, and every decision or real-world action. You must independently verify outputs before relying on them and must not use Protocol where an error, delay, or interruption could cause death, personal injury, or serious property or environmental harm.

License

Subject to these Terms and applicable marketplace terms, Artful Intelligence grants you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use Protocol on devices you own or control solely for its intended purpose.

Protocol is licensed, not sold. Artful Intelligence and its licensors retain all right, title, and interest in the app, services, software, designs, names, logos, content, and related intellectual property except for content you own and enter. No rights are granted by implication.

Acceptable use

You may not misuse Protocol or help anyone else do so.

• Do not violate law, professional duties, prescription requirements, intellectual-property rights, privacy rights, or another person's rights.
• Do not use Protocol to facilitate unlawful, counterfeit, adulterated, mislabeled, unapproved, non-prescribed, or unsafe products or conduct.
• Do not bypass security, probe or disrupt services, introduce malicious code, scrape at unreasonable volume, abuse accounts, or attempt unauthorized access.
• Do not reverse engineer, decompile, modify, distribute, rent, lease, sell, sublicense, or create derivative works except to the limited extent a restriction is prohibited by law.
• Do not represent Protocol output as professional advice, regulatory authorization, proof of compliance, or a verified source of truth.

Your content, exports, and feedback

As between you and Artful Intelligence, you retain ownership of information you enter. You grant us a limited license to host, process, transmit, reproduce, and disclose that information only as needed to provide requested services, operate and secure Protocol, comply with law, and enforce these Terms.

You represent that you have all rights and permissions needed for information you enter, scan, import, export, or send. Exports are unencrypted files once created and are controlled by you and the destination you select.

If you submit ideas or feedback, you permit us to use them without restriction or compensation, but this does not grant us ownership of your medical records or other user content.

Accounts, recovery keys, and backup

You are responsible for maintaining control of your device, email, Apple account, authentication links, and recovery key. Notify us promptly of suspected unauthorized access. We may suspend or terminate an account to protect the service, comply with law, address risk, or enforce these Terms.

Optional account backups are encrypted on your device. We do not promise that any backup, recovery point, export, reminder, or record will always exist, upload, decrypt, restore, or remain compatible. If you lose the recovery key, encrypted data may be permanently unrecoverable. Keep independent records appropriate to the importance of your data.

Third-party and Apple terms

Protocol relies on operating-system features and may interact with third-party services or destinations governed by separate terms. Artful Intelligence is not responsible for third-party services, content, availability, or conduct.

If you obtained Protocol through Apple, these Terms supplement applicable Apple Media Services Terms and Apple's Standard Licensed Application End User License Agreement and do not reduce non-waivable rights under those terms. Apple is not a party to these Terms and has no obligation to furnish maintenance or support. To the extent required by Apple's minimum terms, Apple and its subsidiaries are third-party beneficiaries entitled to enforce the applicable provisions against you after your acceptance. Artful Intelligence, not Apple, is responsible for addressing claims relating to Protocol, subject to these Terms and applicable law.

Changes, beta features, and availability

Protocol may include beta, preview, or experimental features that are incomplete, inaccurate, or changed without notice. We may modify, suspend, discontinue, limit, or update any feature or service, and may impose reasonable limits to protect users or infrastructure.

We do not guarantee uninterrupted operation, compatibility, notifications, data retention, catalog availability, support response, or correction of every defect. Updates may be required to continue using Protocol.

Disclaimers of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, PROTOCOL AND ALL RELATED CONTENT AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND. ARTFUL INTELLIGENCE DISCLAIMS EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AVAILABILITY, SECURITY, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT OUTPUTS, DEFAULTS, FORMULAS, CATALOG DATA, REMINDERS, RECORDS, EXPORTS, BACKUPS, OR OTHER FUNCTIONS ARE ACCURATE, COMPLETE, CURRENT, SAFE, ERROR-FREE, OR SUITABLE FOR YOUR CIRCUMSTANCES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO THESE EXCLUSIONS APPLY ONLY TO THE EXTENT LAWFUL.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ARTFUL INTELLIGENCE AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; PERSONAL OR BUSINESS INTERRUPTION; LOST PROFITS, REVENUE, GOODWILL, OR DATA; LOSS OF USE; COST OF SUBSTITUTE SERVICES; OR DAMAGES ARISING FROM USER INPUT, REAL-WORLD ACTIONS, THIRD-PARTY PRODUCTS, MISSED NOTIFICATIONS, OR LOST RECOVERY KEYS, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF ARTFUL INTELLIGENCE FOR ALL CLAIMS ARISING FROM OR RELATING TO PROTOCOL WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID ARTFUL INTELLIGENCE FOR PROTOCOL DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR ONE HUNDRED U.S. DOLLARS (US $100).

These limitations do not exclude liability or remedies that cannot lawfully be excluded or limited, including liability to the extent caused by conduct for which applicable law forbids limitation. Each limitation is intended to apply independently and to the maximum lawful extent.

Indemnification

To the fullest extent permitted by law, you will defend, indemnify, and hold harmless Artful Intelligence and its members, managers, employees, contractors, licensors, and service providers from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful or unauthorized use, your content, your breach of these Terms, or your violation of another person's rights. This obligation does not apply to the extent a claim was caused by conduct for which applicable law does not permit indemnification.

Termination

You may stop using Protocol at any time and may delete local data or your optional account using available controls. We may suspend or terminate access for a material breach, legal requirement, security risk, discontinued service, or conduct that could harm others or Protocol.

Provisions that by their nature should survive termination will survive, including ownership, disclaimers, liability limits, indemnification, dispute terms, and accrued obligations.

Governing law and disputes

Except where mandatory law provides otherwise, these Terms are governed by North Carolina law without regard to conflict-of-law rules. You and Artful Intelligence consent to exclusive jurisdiction and venue in the state courts located in Wake County, North Carolina, or the federal court serving that county, for disputes not otherwise resolved informally.

Before filing a claim, each party agrees to provide written notice describing the dispute and allow at least 30 days for a good-faith attempt to resolve it, unless immediate relief is reasonably necessary or the applicable limitations period would expire. Nothing here waives a non-waivable consumer protection or statutory right.

General terms

These Terms, the Privacy Policy, the Health & Safety Disclaimer, and applicable marketplace terms are the entire agreement about Protocol. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remainder will remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, merger, acquisition, or asset transfer.

We may update these Terms prospectively. The current revision and effective date appear in the app and online. Material changes may require renewed acceptance. Continued use after effective notice constitutes acceptance only to the extent permitted by law. Headings are for convenience and do not affect interpretation.
